About the Sub Above Fund
The Sub Above Fund, Inc. (“The Sub Above Fund”) is a New Jersey non-profit corporation that was founded to support members of the Jersey Mike's team in times of crisis. Eligible individuals may apply to The Sub Above Fund for financial assistance when facing an unexpected financial hardship event due to certain emergency situations.
Any of the following individuals may apply when facing a sudden,
severe and unexpected hardship event that is beyond their control and strains their financial resources:

Active full-time or part-time employees of the following,
so long as they are in good standing and have been employed for at least ninety (90)
consecutive days as of the date the qualifying hardship event occurs:
- Any Jersey Mike’s franchisee in the United States
- Any Jersey Mike’s area director in the United States
- Jersey Mike’s Franchise Systems, Inc., or its affiliates, except executive and management employees and their immediate family members
- Any individual Jersey Mike’s franchisee in the United States, or owner of a Jersey Mike’s franchisee in the United States if the franchisee is an entity who is in good standing under their franchise agreement and has been a franchisee for at least ninety (90) consecutive days.
- Any individual Jersey Mike’s area director in the United States, or owner of a Jersey Mike’s area director in the United States if the area director is an entity who is in good standing and has been an area director for at least ninety (90) consecutive days.
- In the case of the death of an individual in one of the above categories, the individual’s Eligible Family Members may apply. “Eligible Family Members” means the individual’s spouse, domestic partner, civil union partner, parent (including a biological parent, parent-in-law, or legal guardian), child (including a biological, adopted or foster child, stepchild, legal ward or child of a person standing in the place of a parent), and/or other legally recognized dependents.
Other than in the case of the death of an employee, only employees who are currently employed in one of the above categories are eligible to apply and receive assistance.
Resignation or termination disqualifies the individual from eligibility. In the case of the death of an employee,
the employee must have been employed for at least ninety (90) consecutive days at the time of death.
Eligible applicants are not guaranteed to receive assistance. An individual may apply no more than once every six (6) months.
If financial assistance is granted by The Sub Above Fund to any employees of a Jersey Mike’s franchisee or any employees
of a Jersey Mike’s area director, such assistance shall not create, constitute or imply an employer-employee relationship between such individual,
on the one hand, and A Sub Above, LLC, The Sub Above Fund, Inc., and/or Jersey Mike’s Franchise Systems, Inc., or any of its affiliates, on the other hand.
The applicant’s financial difficulties must be directly caused by an emergency or unforeseen event outside the applicant’s control.
The event must be sufficiently severe that it makes it difficult for the individual to pay for his or her basic needs, including housing,
food, utilities, transportation related to the qualified hardship, and childcare.
Examples of events that may qualify for assistance include, but are not necessarily limited to:
- Serious injury, disability, or illness, if it does not fall under worker’s compensation and is not covered by insurance
- Natural and other disasters, house fire, or other unavoidable major home damage to the applicant’s primary residence. The Sub Above Fund will not provide assistance grants to repair other property
- Death in the family
- Serious crime against the applicant or an immediate family member
Examples of events that do not typically qualify for assistance include, but are not necessarily limited to:
- Loss of employment
- Increases in ongoing bills
- Accumulated financial distress, such as credit card debt unrelated to an emergency
- Expenses of divorce or child custody cases
- Home foreclosure or bankruptcy costs
Assistance is intended for an applicant’s basic needs, such as housing, food, utilities, transportation, and childcare.
Assistance does not cover expenses covered by insurance or insurance costs.
Eligible applicants are not guaranteed to receive assistance. Assistance is subject to the availability of funds,
the extent of the applicant’s need, and satisfactory completion of the application, in each case, as determined by the Board (as defined below).
Eligible applicants may receive less than the amount of financial assistance requested or no assistance at all. There is no right of appeal.
Eligible individuals may apply by submitting a completed application on The Sub Above Fund’s website.
Applicants should complete the application as fully as possible.
Additional documentation may be requested. The Sub Above Fund reserves the right to require supporting detail and/or documentation
to support each eligible applicant’s application, depending on the individual circumstances. A non-exhaustive list of common documents includes:
photos of damage, personal financial statements (verification of family income and expenses and other assets), insurance claims,
explanations of benefits and deductibles, police reports, repair estimates with readily verifiable vendor contact information, receipts of incurred expenses,
overdue billing statements, certification of a medical condition, certificate of death, medical bills, funeral costs/estimates,
W-9 of the creditor to whom a payment is being issued and other documentation. The applicant’s employer, if applicable, will be contacted to confirm eligibility.
The Sub Above Fund’s Board of Directors (the “Board”) meets regularly and will review completed applications and select recipients
of assistance based upon an objective determination of need. The Board is composed of a majority of individuals who are not in a
position to exercise substantial influence over the affairs of Jersey Mike’s Franchise Systems, Inc., its affiliates,
any Jersey Mike’s franchisee or area director. Board members act in a capacity as agents of The Sub Above Fund rather than as
representatives of Jersey Mike’s Franchise Systems, Inc. Information provided by applicants will be shared with your employer for verification purposes.
The Board may change the eligibility criteria and application process at any time without notice.
